The Business

A landscaping company in North Carolina operated a fleet of six trucks — three F-250s with trailers and three cargo vans. The company employed 18 workers across four crews serving residential and commercial properties.

The owner had purchased commercial auto insurance when the company started with two trucks, but hadn't updated the policy as the fleet grew. Three of the six vehicles were listed on the policy; the other three were covered under personal auto policies.

The Problem

During morning rush hour, one of the crew trucks (an F-250 towing a loaded trailer) rear-ended a sedan on I-40. The sedan's driver suffered a herniated disc and whiplash requiring surgery. The sedan was totaled.

The total claim — medical expenses, lost wages, vehicle replacement, and pain and suffering — reached $450,000. The truck involved was one of the three on personal auto policies, which explicitly exclude commercial use. The personal insurer denied the claim entirely.
